Brett M. Halsey specializes in commercial litigation, and in particular franchise litigation, construction litigation and appeals. Brett's representations include successfully defending multi-million dollar claims against large franchisors around the world, in both U.S. and international arbitrations, and in federal court. Brett is part of a team that serves as franchise counsel to Restaurant Brands International and its Burger King® and Popeyes® brands, and has also successfully handled litigation for GAP, Inc. Brett's substantive experience in franchise litigation ranges from complicated merchandise inventory and freight disputes, to food product supply chain and quality control issues, to disputes arising from complex franchise and development agreement provisions. Brett has substantial experience in construction disputes, having represented owners, condominium associations and developer/contractors in both state and federal court. Brett has also served as litigation counsel for a federal Receiver.

Prior to joining the firm, Brett was a partner at Tew Cardenas LLP, where he prosecuted and defended complex commercial disputes including legal and accounting malpractice cases, general breach of contract disputes, business torts claims, securities fraud claims and complex construction disputes, including representing the Miami-Dade County School Board and Fisher Island Holdings, defending a $200 million claim by a bankrupt corporation involved in Ponzi scheme, and recovering $47.7 million from the Republic of Cuba on behalf of the family of a terrorist victim through the Terrorism Risk Insurance Act.

Brett has received multiple awards for his work, including the 2007 "Most Effective Lawyer in International Law" award from the Daily Business Review, and most recently from the Franchise Times, which named him a Legal Eagle for 2022. He is a member of the Dade County Bar Association and served as an adjunct professor at University of Miami School of Law teaching a course in Business Litigation Skills.

Brett is a member of The Florida Bar and is admitted to practice before the United States District Courts for the Southern and Middle Districts of Florida, the Northern District of Illinois, and the Eleventh Circuit Court of Appeals. He received his juris doctor, cum laude, from the University of Miami School of Law in 1999 and bachelor of science, cum laude, in business management and marketing from Cornell University in 1993, where he served as a teaching assistant and Ambassador for his college.
